Attorney Opinion for Parole Hearing or PTA readiness - Document Review
LEGAL SERVICE SUMMARY: We will review the relevant documents (normally over 200 pages) for a Subsequent Parole Hearing and evaluate your readiness to appear in front of the Board Of Parole Hearings (Board) or readiness to file a well prepared Petition to Advance (PTA).
This is a flat discounted Web Attorney's fee for an Opinion Letter regarding your subsequent Parole Hearing, or the possibility of filing a Petition to Advance (PTA). This legal opinion analyzes your readiness to go in front of the BOARD. It also recommends the best strategy for a short-term and long-term approach to eventually gain a Parole Date. The attorney analyzes the prior transcript and any Admin Review (AR) or PTA that was denied. She reviews legal jurisdictions for any possibility of filing or re-filing the PTA. The attorney also provides recommendations as to what is missing in the parole packet (if anything) or what could be added in your presentation (or parole packet) before going to the BOARD, or filing and/or re-filing a PTA.
The Opinion is crucial to understand "readiness" before the hearing to avoid lengthy Denials per Marsy's Law. (i.e. a minimum of 3-year, with a maximum of 15-year Denial). Your Loved One should properly be prepared for the hearing or know if they have a chance of success, at filing a Petition To Advance his/her hearing.
This rate does NOT include any on-site visits. If you want a face-to-face on-site then purchase ("ATTORNEY hire $1000” or "ATTORNEY hire $1500") depending on the Prison location from our San Diego based Law office or . NOTE: COVID19 is restricting / limiting prison visits.
The inmate will need to provide (i.e. mail to our office) different available documentations for the analysis. NOTE: Our law office can obtain the Parole Hearing Transcript electronically. Below are recommended documents needed:
1) Transcript of the last Parole Hearing
1A) Petition To Advance (PTA) filed and the Decision sheet of the PTA or AR Denial
2) *Most recent Psychological Report, (aka Comprehensive Risk Assessment (CRA))
3) *Most recent Post-Conviction Report, written by the counselor.

The “Attorney Packet” will normally contain most of the above documents and more. This packet can be requested from your last attorney. The attorneys are provided this packet by the prison - each time the State Appointed (or private) attorney represents you. NOTE: Any hearing conducted post-2014 (or so) will only have an Electronic format of the "Attorney Packet", thus the prior attorney MAY be able to print a copy of the requested documents or the inmate may be able to get a copy from his C-file, via his/her Counselor.
